A fact-finding team comprising Nelson P. Raj of the People\u2019s Union for Civil Liberties (PUCL) and V. Chandrasree of the Association of Prisoners\u2019 Families for Justice (APFJ) visited the family on November 28, documenting allegations of severe custodial torture and intimidation.<\/p>\n<p data-start=\"832\" data-end=\"1176\">Darshan, a resident of Sonenahalli near Viveknagar, was the primary earner for his family, which includes his wife Ashwini (22), a young daughter, and his parents. According to relatives and neighbours\u2014most of whom spoke anonymously fearing police reprisals\u2014the 24-year-old was picked up by Viveknagar Police during the second week of November.<\/p>\n<h2 data-start=\"1178\" data-end=\"1237\"><strong data-start=\"1181\" data-end=\"1237\">\u2018Beaten Black and Blue\u2019: Witness Accounts of Torture<\/strong><\/h2>\n<p data-start=\"1238\" data-end=\"1437\">Relatives allege that Darshan was illegally detained for <strong data-start=\"1295\" data-end=\"1318\">three to seven days<\/strong>, during which he was repeatedly assaulted by police personnel, including Inspector Shivakumar and Sub-Inspector Pawan.<\/p>\n<p data-start=\"1439\" data-end=\"1817\">Witnesses claim he was beaten with lathis below the knee and subjected to daily torture. One friend who managed to see him inside the station recalled that Darshan was \u201ccrawling in pain\u201d and unable to stand. \u201cHis knees looked broken,\u201d the friend said. Witnesses say officers dragged him into a separate room and resumed beating him in front of them before forcing them to leave.<\/p>\n<figure id=\"attachment_6345\" aria-describedby=\"caption-attachment-6345\" style=\"width: 256px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-6345 size-full\" src=\"https:\/\/belgaumnow.com\/wp-content\/uploads\/2025\/11\/fact-finding.jpg\" alt=\"\" width=\"256\" height=\"346\" srcset=\"https:\/\/belgaumnow.com\/wp-content\/uploads\/2025\/11\/fact-finding.jpg 256w, https:\/\/belgaumnow.com\/wp-content\/uploads\/2025\/11\/fact-finding-222x300.jpg 222w\" sizes=\"auto, (max-width: 256px) 100vw, 256px\" \/><figcaption id=\"caption-attachment-6345\" class=\"wp-caption-text\">\u201cCustodial Death Shock: 24-Year-Old Returned Home in a Body Bag\u201d<\/figcaption><\/figure>\n<p data-start=\"1819\" data-end=\"2008\">One police officer allegedly told them, <em data-start=\"1859\" data-end=\"1932\">\u201cYou slum dwellers deserve this; I will ensure you meet the same fate,\u201d<\/em> reflecting what locals describe as a pattern of casteist abuse and threats.<\/p>\n<p data-start=\"2010\" data-end=\"2183\">After this episode, friends and family were barred from accessing Darshan. Police reportedly told them he needed \u201ctreatment\u201d and would be shifted to a rehabilitation centre.<\/p>\n<h2 data-start=\"2185\" data-end=\"2243\"><strong data-start=\"2188\" data-end=\"2243\">Death at Rehab Centre and Restricted Access to Body<\/strong><\/h2>\n<p data-start=\"2244\" data-end=\"2531\">Darshan was later moved to <strong data-start=\"2271\" data-end=\"2321\">Unity Foundation Rehabilitation Centre, Makali<\/strong>, where he reportedly died. His body was sent to Victoria Hospital mortuary on November 27. Family members say they were denied access to the body while senior police officials remained present at the hospital.<\/p>\n<p data-start=\"2533\" data-end=\"2846\">His remains were brought to his home in Viveknagar the following evening. Notably, personnel from multiple stations\u2014Adugodi, Koramangala and Ashoknagar\u2014were deployed, but <strong data-start=\"2704\" data-end=\"2745\">no one from Viveknagar Police Station<\/strong> was present. Darshan was buried at the Shantinagar Hindu burial ground around 6 p.m. on November 28.<\/p>\n<h2 data-start=\"2848\" data-end=\"2897\"><strong data-start=\"2851\" data-end=\"2897\">Locals Accuse Police of Routine Harassment<\/strong><\/h2>\n<p data-start=\"2898\" data-end=\"3177\">Residents of the Viveknagar slum allege that custodial harassment is a frequent occurrence. Several young men are reportedly picked up without formal charges, detained for two to three days, assaulted, and released only after families pay amounts ranging from \u20b910,000 to \u20b980,000.<\/p>\n<p data-start=\"3179\" data-end=\"3352\">Community members accuse specific Crime Branch personnel of routinely using slurs such as:<br data-start=\"3269\" data-end=\"3272\" \/><em data-start=\"3272\" data-end=\"3352\">\u201cWe will ruin your lives, file false cases, and make sure you do not survive.\u201d<\/em><\/p>\n<p data-start=\"3354\" data-end=\"3582\">Locals say the situation worsened during the tenure of a former inspector and has continued under new station heads. \u201cIf the media had not reported the death, even the body would not have been handed over,\u201d one resident alleged.<\/p>\n<h2 data-start=\"3584\" data-end=\"3635\"><strong data-start=\"3587\" data-end=\"3635\">Criminal Case Filed Against Police Personnel<\/strong><\/h2>\n<p data-start=\"3636\" data-end=\"3806\">Following public outcry, <strong data-start=\"3661\" data-end=\"3715\">Madanayakanahalli Police Station registered an FIR<\/strong> against four Viveknagar Police personnel\u2014 including the inspector and a constable\u2014under:<\/p>\n<ul data-start=\"3807\" data-end=\"3957\">\n<li data-start=\"3807\" data-end=\"3862\">\n<p data-start=\"3809\" data-end=\"3862\"><strong data-start=\"3809\" data-end=\"3860\">Bharatiya Nyaya Sanhita Section 103(1) (Murder)<\/strong><\/p>\n<\/li>\n<li data-start=\"3863\" data-end=\"3924\">\n<p data-start=\"3865\" data-end=\"3924\"><strong data-start=\"3865\" data-end=\"3922\">SC\/ST (Prevention of Atrocities) Act, Section 3(2)(v)<\/strong><\/p>\n<\/li>\n<li data-start=\"3925\" data-end=\"3957\">\n<p data-start=\"3927\" data-end=\"3957\">Additional relevant provisions<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"3959\" data-end=\"3992\"><strong data-start=\"3962\" data-end=\"3992\">Background of the Deceased<\/strong><\/h2>\n<p data-start=\"3993\" data-end=\"4226\">Darshan had a previous criminal case\u2014Crime No. 136\/2022\u2014under Sections 399 and 402 of the Indian Penal Code. A rowdy-sheeter history was also opened against him. He was granted bail by a Bengaluru sessions court on September 9, 2025.<\/p>\n<p data-start=\"4228\" data-end=\"4352\">His family and friends, however, maintain that irrespective of his background, the police had no authority to brutalize him.<\/p>\n<h2 data-start=\"4354\" data-end=\"4407\"><strong data-start=\"4357\" data-end=\"4407\">Custodial Deaths: A Persistent National Crisis<\/strong><\/h2>\n<p data-start=\"4408\" data-end=\"4625\">Darshan\u2019s death adds to India\u2019s long list of custodial fatalities, which courts have repeatedly condemned.
